Governance policy & platform ownership

This Governance Policy ("Policy") establishes the fundamental ownership, access rights, and governance structure of the Duel Commander platform, including but not limited to websites, domain names, social media accounts, source code, server infrastructure, and all related digital assets (collectively, the "Platform").

This Policy is designed to ensure the continuity, stability, and community-driven nature of Duel Commander by establishing irrevocable rights that protect the format from unilateral control by any single individual.

1.1 Platform ownership

The Platform, including all content, infrastructure, intellectual property, and associated assets, belongs irrevocably and collectively to the members of the Duel Commander Committee ("Committee") as defined in Article 2.

1.2 Irrevocable nature

The ownership and access rights established by this Policy are irrevocable, perpetual, and binding on all parties, including:

• Current and future domain name registrants
• Current and future server administrators
• Current and future hosting service providers
• All Committee members, current and future
• Any successors, assigns, or transferees

1.3 No unilateral revocation

No individual, regardless of their technical role or administrative position, may:

• Unilaterally revoke, suspend, or restrict access rights of any Committee member
• Transfer ownership or control of Platform assets without Committee consensus
• Delete, modify, or destroy Platform content or infrastructure without Committee authorization
• Change passwords, credentials, or access mechanisms to exclude Committee members
• Terminate services or hosting without Committee approval

2.1 Committee composition

The Duel Commander Committee consists of all individuals holding official positions within the Committee structure as of October 6, 2025, and all future appointees, including but not limited to:

• Core Members
• Consultants
• Community Managers
• Format Development Team members
• Any other officially recognized Committee positions

2.2 Rights of Committee members

Each Committee member is entitled to:

• Full administrative access to all Platform systems and infrastructure
• Access to all credentials, passwords, and authentication mechanisms
• Source code access and modification rights
• Domain name management capabilities
• Hosting and server configuration access
• Social media account access and posting rights

2.3 Perpetual application

This Policy applies to all Committee members who hold their position at the time any access request is made, without limitation in time or circumstance.

3.1 Digital assets

This Policy covers all digital assets associated with Duel Commander, including:

• Domain names: all current and future domain names, subdomains, and DNS configurations
• Websites: all website files, databases, content management systems, and web applications
• Source code: all software code, scripts, libraries, and documentation
• Server infrastructure: virtual machines, hosting accounts, cloud services, and configurations
• Credentials: all passwords, API keys, certificates, and authentication tokens
• Social media: all social media accounts, pages, groups, and associated content
• Communication platforms: Discord servers, email accounts, forums, and messaging systems
• Content: rules documents, announcements, artwork, videos, and all published materials

3.2 Administrative rights

All administrative privileges, ownership roles, and management capabilities are subject to this Policy and must remain accessible to the Committee.

4.1 Domain registrants

Any individual or entity holding domain name registrations for Duel Commander must:

• Maintain shared access with all Committee members to domain management interfaces
• Not transfer, sell, or allow domains to lapse without Committee authorization
• Provide immediate access credentials upon request by any Committee member
• Execute domain transfers as directed by Committee consensus

4.2 Server administrators

Individuals with server or hosting administration rights must:

• Grant root/administrator access to all Committee members upon request
• Document all system configurations and provide documentation to the Committee
• Not terminate services or modify critical infrastructure without Committee approval
• Maintain redundant backups accessible to the Committee

4.3 Code repository owners

Maintainers of source code repositories must:

• Grant administrative access to all Committee members
• Not delete repositories or revoke access without Committee consensus
• Ensure code remains available under Committee-accessible licensing

5.1 Committee content responsibility

The Duel Commander Committee assumes full and exclusive responsibility for all content published, distributed, or hosted on the Platform, including but not limited to:

• Rules documents and official announcements
• Banned and restricted lists
• Articles, guides, and educational content
• Social media posts and communications
• User-generated content moderated by the Committee
• All other materials published under the Duel Commander name

5.2 Technical administrator liability protection

Technical administrators, including domain registrants, server administrators, hosting providers, and infrastructure maintainers ("Technical Administrators"), shall not be held liable, responsible, or accountable for:

• The content of materials published by the Committee
• Statements, opinions, or positions expressed by the Committee
• Decisions regarding format rules, bans, or restrictions
• Community management actions or moderation decisions
• Any disputes arising from content published on the Platform

5.3 Technical administrator role

Technical Administrators provide infrastructure and technical services only. Their role is limited to:

• Maintaining server uptime and technical functionality
• Ensuring platform security and performance
• Providing access to authorized Committee members
• Executing technical changes as directed by the Committee

Technical Administrators do not exercise editorial control over content and are not responsible for reviewing, approving, or moderating Committee-published materials.

5.4 Indemnification

The Committee agrees to indemnify, defend, and hold harmless all Technical Administrators from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from:

• Content published or distributed through the Platform
• Committee decisions, statements, or actions
• Third-party claims related to Platform content
• Any disputes regarding format governance or community management

5.5 Exception for illegal content

This liability protection does not extend to content that is:

• Explicitly illegal under applicable law
• In violation of criminal statutes
• Subject to court orders or legal injunctions

Upon notification of illegal content, Technical Administrators retain the right to:

• Remove or suspend access to illegal content
• Comply with law enforcement requests
• Take necessary actions to comply with legal obligations

Technical Administrators must notify the Committee promptly of any such actions and provide reasonable opportunity for the Committee to address legal concerns.

5.6 Committee authority over content

All editorial decisions, content approval, publication timing, and material removal (except as provided in Section 5.5) remain under the exclusive authority of the Committee. Technical Administrators shall not unilaterally remove, modify, or censor content except in cases of clear illegality as defined in Section 5.5.

6.1 Committee consensus

Major decisions affecting Platform ownership or access require consensus among Committee members through established voting procedures.

6.2 Breach of policy

Any action taken in violation of this Policy, including but not limited to unilateral access revocation or unauthorized asset transfers, is considered null and void and subject to immediate remediation.

6.3 Good faith cooperation

All parties acknowledge that this Policy is established to protect the community-driven nature of Duel Commander and agree to cooperate in good faith to maintain shared governance.

6.4 Severability

If any provision of this Policy is found to be unenforceable, the remaining provisions shall remain in full force and effect.

7.1 Amendment process

This Policy may only be amended by consensus of the Committee. No single individual may unilaterally modify, suspend, or terminate this Policy.

7.2 Binding on successors

This Policy binds all future Committee members, administrators, domain holders, and any other parties who assume roles related to Platform management.

7.3 Perpetual duration

This Policy has no expiration date and remains in effect in perpetuity, ensuring the long-term stability and community governance of Duel Commander.

7.4 Acknowledgment

By accepting any role related to Duel Commander administration, infrastructure, or Committee membership, individuals acknowledge and accept the terms of this Policy.

This Policy is established by and for the Duel Commander Committee to ensure the perpetual community-driven governance of the format.

This Policy applies to all current Committee members as of the effective date and all future members without limitation in time.
